How is Temporary Total Disability (TTD) Calculated?

As mentioned, TTD benefits compensate the injured worker at 66 2/3 percent of their average weekly wage. To calculate your TTD benefits,  assess your earnings in the 52-week period preceding the date of your injury. This excludes overtime or bonuses. Overtime may be included in the average weekly wage if you were expected to work overtime regularly or if you worked a set number of overtime hours each week in the year prior to your injury.

According to Illinois law, if the injured worker missed five or more calendar days in the year preceding the date of injury, the TTD rate is calculated by dividing total earnings received in the prior year by the number of weeks worked. For example, if you are a carpenter, and only work 40 weeks out of the year due to weather conditions, then your average weekly wage and TTD benefits would be calculated by dividing the earnings in the year preceding your injury by 40.

TTD payments begin on the day the injured worker is unable to work.  The first 3 days are paid if the worker misses 14 calendar days.

In our experience as attorneys who represent injured workers, employers’ worker’s compensation carriers quite often underpay TTD wages, particularly to workers not represented by a lawyer. Anecdotally, we can report that for every injured worker who receives more TTD benefits than they should, there are another 10-20 people who are being underpaid.
